Please read these Terms and Conditions carefully before placing an order or using this website. By accessing our site or purchasing from us, you agree to be bound by the terms set out below.

1.  Acceptance of Terms

By accessing or using the website www.mabelbaby.com (Our House Holdings (Pty) Ltd t/a Mabel™), or placing an order with Our House Holdings (Pty) Ltd t/a Mabel™, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Site.

These Terms constitute the entire agreement between you and Our House Holdings (Pty) Ltd t/a Mabel™ with respect to your use of the Site and any purchases made through it.

2.  Eligibility

You must be at least 18 years of age to place an order on our Site. By using this Site, you confirm that you are 18 or older, or that you have obtained consent from a parent or legal guardian.

We reserve the right to refuse service, cancel orders, or close accounts at our discretion.

3.  Products & Availability

We have made every effort to display the colours, images, and descriptions of our products as accurately as possible. However, we cannot guarantee that your device’s screen will accurately reflect the actual colour or appearance of the product.

  • All products are subject to availability and may be withdrawn at any time.
  • We reserve the right to limit quantities of any products or services we offer.
  • Product descriptions are provided in good faith and are subject to change without notice.

4.  Product Use & Safety

Our products are designed for use by infants and young children under adult supervision. 

  • Customers are responsible for ensuring that products are used safely and appropriately. Products should be inspected before each use, and discontinued immediately if damaged.
  • Our products are not toys and should never be used without adult supervision.
  • To the fullest extent permitted by law, we are not liable for any misuse, improper handling, or failure to follow safe usage practices.
  • Products should always be used in accordance with age recommendations.

5.  Pricing & Payment

All prices displayed on the Site are in South African Rand (ZAR) and include all applicable taxes where required by law, unless stated otherwise.

  • We reserve the right to change prices at any time without prior notice.
  • In the event of a pricing error, we will notify you and offer the option to proceed at the correct price or cancel your order.
  • Payment must be made in full at the time of ordering. We accept the payment methods listed at checkout.
  • Your payment details are processed securely. We do not store your full card details on our servers.
  • Our VAT registration is currently pending. Once registered, VAT will be applied in accordance with South African law, and our VAT number will be updated on the Site.

6.  Orders & Confirmation

Placing an order on our Site constitutes an offer to purchase. A binding contract is only formed once we send you an order confirmation email confirming that your order has been accepted.

  • We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, payment issues, or stock unavailability.
  • If your order is cancelled after payment, you will receive a full refund within 5 business days.
  • Please ensure your delivery address and contact details are correct at the time of ordering. We are not responsible for delays or losses due to incorrect information provided.

7.  Shipping & Delivery

We currently deliver within South Africa. 

  • Estimated delivery times are provided at checkout and are estimates only — they are not guaranteed.
  • Shipping costs are calculated at checkout based on your location and selected shipping method.
  • Delivery is deemed to have taken place when the goods are delivered to the address provided at checkout.
  • Risk of loss passes to you upon delivery of the goods to the address provided.
  • While we work with reputable courier partners, we are not responsible for delays caused by third-party couriers or circumstances beyond our reasonable control.
  • If your order has not arrived within the estimated timeframe, please contact us at accounts@ourhouseholdings.co.za.

8.  Returns & Refunds

We want you to be completely satisfied with your purchase. Our returns policy is governed by the Consumer Protection Act 68 of 2008 (CPA) of South Africa.

  • For hygiene and safety reasons, we reserve the right to refuse returns of products that have been opened, used, or are not in a resalable condition, unless the item is defective or incorrect.
  • You may return most items within 30 days of delivery, provided they are unused, in their original packaging, and in resalable condition.
  • In accordance with Section 44 of the Consumer Protection Act, customers may cancel an online order within 5 business days of delivery (“cooling-off period”). A full refund will be provided, excluding reasonable return shipping costs.
  • To initiate a return, please contact us at accounts@ourhouseholdings.co.za, with your order number and reason for return.
  • Return shipping costs are the responsibility of the customer unless the item is defective, damaged, or incorrect.
  • Refunds will be processed within 5 business days of receiving and inspecting the returned item, to your original payment method.


Your CPA Rights: Under the Consumer Protection Act, you have the right to receive goods of good quality, in good working order, and free of defects. If a product is defective, you may be entitled to a repair, replacement, or refund within 6 months of purchase.

 

9.  Warranty

Where applicable, products sold on our Site may carry a manufacturer’s warranty. Details of any such warranty will be included with the product or available on request.

Nothing in these Terms limits or excludes your rights under the Consumer Protection Act 68 of 2008 or any other applicable South African law.

10.  Limitation of Liability

To the fullest extent permitted by South African law, Our House Holdings (Pty) Ltd t/a Mabel™ shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Site or purchase of products.

Our total liability to you for any claim arising from a transaction shall not exceed the amount you paid for the relevant product.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.

11.  Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, power outages, strikes, pandemics, civil unrest, or courier disruptions.

12.  Intellectual Property

All content on this Site — including text, images, logos, graphics, and design — is the property of Our House Holdings (Pty) Ltd t/a Mabel™ or its licensors and is protected by applicable intellectual property laws.

Mabel™ is a pending trademark of Our House Holdings (Pty) Ltd.

You may not reproduce, distribute, modify, or use any content from this Site without our prior written consent.

13.  Privacy

Your privacy is important to us. Our use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

By using our Site, you consent to the collection and use of your personal information in accordance with our Privacy Policy. You have the right to access, correct, or request deletion of your personal information, and to opt out of marketing communications at any time.

We handle your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

14.  Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of South Africa.

15.  Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
